1. Operator and agreement
Andromalius is a software product provided by Richard Kowalczyk, a New York sole proprietor. “Andromalius,” “we,” and “us” refer to that software product and its operator. Andromalius is not a separate company.
By requesting an audit, submitting an x402 payment authorization, or using a paid report, you agree to these Terms, the Privacy Notice, Acceptable Use Policy, and Refund Policy. If you act for an organization, you represent that you can bind it.
2. Eligibility and beta scope
The founding beta is offered only to United States business users who are at least 18 years old and use the service for business or professional purposes. It is not offered for personal, family, or household use. You may use it only where lawful and must not use it if sanctions, export controls, or another legal restriction prohibits the transaction.
3. Service
Andromalius performs automated analysis of caller-supplied x402 challenges and OpenAPI documents. It does not fetch arbitrary URLs, retain submitted audit artifacts by default, provide penetration testing, or certify that any system is secure or compliant. Reports are informational technical outputs—not legal, financial, investment, or security advice.
4. Prices, Base USDC, and delivery
The founding-beta price is $0.01 USDC for a challenge audit and $0.02 USDC for a discovery audit. Before authorization, the x402 challenge identifies the exact resource, native USDC asset, Base-mainnet network, receiving address, and amount. The service releases a report only after successful facilitator settlement. Base transactions are public and generally irreversible, and separate wallet or network costs may apply.
The beta is bounded by cumulative ceilings of 1,000 settled calls and 20 USDC gross. The service may stop accepting signed payments when either ceiling is reached while leaving payment-free discovery available.
5. Refunds
Verified duplicate payments and settled payments for which the purchased report was not delivered may qualify for a refund when claimed within 30 calendar days. The Refund Policy explains the evidence, destination, timing, fraud checks, and non-waivable rights.
6. Submitted material and intellectual property
You keep ownership of submitted material and grant us a limited right to process it only to deliver, secure, support, and lawfully operate the service. You represent that you have authority to submit it. We retain rights in the Andromalius software, brand, documentation, and report format. A report may be used for your internal business purposes and shared only when you have the right to share its underlying material.
7. Acceptable use and suspension
You must follow the Acceptable Use Policy. We may reject, rate-limit, suspend, or terminate activity reasonably believed to threaten the service, violate law or these policies, evade controls, or harm another person. Payment-free metadata may remain available during a paid traffic suspension.
8. Availability and disclaimers
The founding beta is deliberately single-node, capacity-limited, and provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free results. Nothing here excludes a warranty or right that law does not permit us to exclude.
9. Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the service. Our aggregate liability arising from the founding beta will not exceed the amount you paid for Andromalius audits during the twelve months before the event giving rise to the claim. This limitation does not apply where prohibited by law or to liability that cannot lawfully be limited.
10. Governing law and disputes
New York law governs these Terms without regard to conflict-of-law rules, except where mandatory law requires otherwise. These interim Terms do not require arbitration and do not include a class-action waiver. A dispute may be brought in a court with lawful subject matter and personal jurisdiction. Before filing, each party should send a concise notice to legal@andromalius.io and allow 30 days for a good-faith attempt to resolve it, unless urgent relief or a filing deadline makes that impracticable.
